Celtic Lettings will prepare the tenancy agreement for you – usually in the form of an Assured Shorthold Tenancy (AST) in accordance with the Housing Act 1988.
The AST is the best form of agreement for landlords because it provides them both with the absolute right to possession and an effective procedure to remove the tenants under certain circumstances.
An AST details the areas of responsibility between you, your tenant and Celtic Lettings as your agent, confirming to all parties who is liable for what in connection with the property.
The AST also clarifies what can or cannot be done to the property and which party is responsible for repairs, maintenance and utility charges.
The signing of the tenancy agreement is not sufficient in itself to regain possession of your property – we will prepare the necessary Housing Act notices to serve, in the correct format and at the appropriate time.
Execution of all documents is part of the service we provide on your behalf, including the signing for you as Agent of the Landlord.
We suggest that the minimum initial tenancy period is 6 months – the maximum we would advise is 12 months.
Landlords must be aware that the legal minimum notice period to tenants under assured tenancies is generally 2 months (should the agreement allow early termination) and this needs to be given even in the case of a fixed term tenancy which is due to expire.
Landlords should also be aware that any tenancy agreement entered into on the their behalf is a binding legal agreement for the term agreed.
